Information on the Processing of Personal Data of Customers and Individuals Entering Premises Monitored by the Data Controller

In accordance with the European Parliament and Council Regulation EU 2016/679 (hereinafter referred to as GDPR)

The purpose of this document is to provide a complete and understandable description of the manner in which personal data of all customers of Happy Garage s.r.o., with registered office at Ovocný trh 572/11, Prague 1 – Old Town, 110 00, ID No.: 07322623 (hereinafter referred to as „the Controller“), are processed and to fully inform such individuals of their rights.

WHAT PERSONAL DATA DOES THE CONTROLLER MANAGE? For customers participating in motorcycle training or any rides at the Pitland area – Name, surname, date of birth; in addition, name, surname, and phone contact of a close person in case of injury; for children and minors under 15 years, also the name, surname, and date of birth of their legal guardian.

For customers who are merely accompanying someone at the premises and moving within it, no personal data is collected.

For customers who have provided consent for processing: Email, phone number.

For individuals who visited the controller’s website: Their IP address.

Records from the camera system monitoring the premises of the controller according to Act No. 89/2012 Coll., the Civil Code.

WHY DOES THE CONTROLLER NEED MY PERSONAL DATA? Personal data is processed to fulfill the rights and obligations arising from the use of services provided by Happy Garage s.r.o. Camera system records are used to ensure safety and protect property, as well as to fulfill the legal obligations of the controller.

WHERE IS MY DATA PHYSICALLY STORED? Personal data entered into the registration system APEX in electronic form is stored on a secure dedicated server located in the Czech Republic, owned by the controller, and only authorized persons have direct access to the personal data stored there.

Personal data in written form is stored in secure cabinets at the controller’s premises, and only authorized personnel have access to them.

HOW LONG WILL THE CONTROLLER MANAGE MY PERSONAL DATA? The controller manages the provided personal data only for the necessary period, which in the case of clients is for the general limitation period under Act No. 89/2012 Coll., the Civil Code, which is three years from the last contact with the customer, extended by a one-year protective period after its conclusion.

Documents containing personal data considered accounting documents are kept for five years from the end of the accounting period to which they relate, as per the Accounting Act. Tax documents are retained for 10 years from the end of the tax period in which the transaction took place.

For camera system recordings, footage is stored for a maximum of 14 days and then automatically deleted. If there is a legal obligation under Act No. 202/1990 Coll. or Act No. 186/2016 Coll., the video recordings are kept for the period specified by these laws (90 days or 2 years).

In the event of court, administrative, enforcement, insolvency, complaint, or similar proceedings, or tax audits requiring the processing of personal data, the data will be processed beyond the aforementioned periods until the end of such proceedings or audits, including extraordinary remedies and proceedings before international institutions (e.g., the European Court of Human Rights).

In case of an extended period for determining taxes under §148 of Act No. 280/2009 Coll., the Tax Code, the retention period for personal data necessary for this purpose is extended to the end of the periods specified by this provision, including the time during which this period does not run, under paragraph 4 of this provision, and the time of any subsequent court proceedings, including extraordinary remedies and proceedings before international institutions (e.g., the European Court of Human Rights).

During the archiving of personal data based on legal requirements, the data is not otherwise used or made available, except for the transfer to the data subject or public authorities based on law, including possible transmission to a law firm.

WHO IS RESPONSIBLE FOR THE MANAGEMENT OF PERSONAL DATA? The controller of personal data is Happy Garage s.r.o., with registered office at Ovocný trh 572/11, Prague 1 – Old Town, 110 00, ID No.: 07322623, registered in the commercial register maintained by the Municipal Court in Prague, section C, insert 299122.

WHO HAS ACCESS TO THE PROVIDED PERSONAL DATA? We take the management of your personal data very seriously, so only a strictly necessary group of individuals has access to this data. Employees of the controller authorized by their job position, as well as its executives and, where applicable, data processors contractually and legally obligated to protect your personal data (e.g., accountants, reservation system administrators, network administrators, law firms), have access to the managed personal data.

In the case of camera system recordings, footage is provided to public authorities when its content may assist in identifying the perpetrator of a crime/offense.

For completeness, we note that we disclose your personal data to third parties when required by law (e.g., in case of a legitimate request from a public authority).

WHAT RIGHTS DO I HAVE REGARDING THE PROVIDED PERSONAL DATA? You have the right to be regularly informed about the scope of your personal data that we manage. Specifically, you have the right to know for what purpose the data is being processed and to whom it is disclosed. You also have the right to request corrections or deletions, or to restrict its processing. You can also object to individual processing methods.

If you believe that your personal data is being handled in violation of the GDPR or the law, you have the right to file a complaint with the Office for Personal Data Protection (supervisory authority).

In this regard, we kindly ask you to notify us first if you suspect any unlawful processing of your personal data before submitting a complaint, and we promise to do everything to resolve and rectify the situation.

You also have the right to request the transfer of all personal data we manage about you in a simple, machine-readable format (text file), or you can ask us to transfer your personal data organized in this way to a third party of your choice.
